By signing up for or using TYVRA Pulse, you agree to these terms. Please read them carefully. If you are accepting on behalf of an organisation, you confirm you have authority to bind that organisation.
These Terms of Service ("Terms") govern your access to and use of TYVRA Pulse, a cloud contact center platform provided by GrayOpus Technologies Pvt. Ltd. ("we", "us", "Company").
By creating an account or using the platform, you ("Customer", "you") agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and GrayOpus Technologies.

We reserve the right to modify, update, or discontinue features of the Service with reasonable notice. We will not make changes that materially reduce core functionality without providing at least 30 days' notice.
To use TYVRA Pulse, you must create an account and provide accurate information. You are responsible for:
We are not liable for any loss or damage arising from your failure to maintain account security.
TYVRA Pulse is offered as a monthly SaaS subscription. Pricing is based on your selected plan and usage volume as described on our pricing page.
Cancellation: You may cancel your subscription at any time by notifying us in writing at hello@tyvra.io. Cancellation takes effect at the end of your current billing period.
Refunds: Monthly subscription fees are non-refundable once a billing period has commenced. Setup fees are non-refundable after onboarding has been completed.
Exception: If the Service is materially unavailable for more than 72 continuous hours in a billing month due to our fault, you are entitled to a pro-rata credit for the affected period. This is your exclusive remedy for service unavailability.
Data on cancellation: After account termination, your data will be retained for 30 days to allow for retrieval, then permanently deleted. We can provide a data export on request before deletion.
You agree to use TYVRA Pulse only for lawful business communication purposes. You must not use the Service to:
We reserve the right to immediately suspend accounts found to be in violation of these provisions, without notice or refund.
You acknowledge that outbound calling and messaging in India is regulated by TRAI and other applicable authorities. You are solely responsible for:
We provide infrastructure and tooling to assist compliance but we are not responsible for your specific use case compliance. We recommend you obtain independent legal advice if you are unsure about your obligations.
Our IP: The TYVRA Pulse platform, software, brand, and all related technology are the exclusive property of GrayOpus Technologies. These Terms grant you a limited, non-exclusive, non-transferable licence to use the Service during your subscription.
Your IP: All content you upload to the platform — including your knowledge base, call scripts, and customer data — remains your property. You grant us a limited licence to process this content solely to provide the Service.
Feedback: If you provide us with suggestions or feedback about the Service, we may use this to improve the platform without any obligation to you.
Our Privacy Policy governs how we collect, use, and protect data. By using the Service, you agree to our Privacy Policy. Where you process personal data of your customers through our platform, we act as a data processor on your behalf and you act as the data controller.
You are responsible for ensuring you have appropriate legal basis for processing your customers' personal data and for complying with the Digital Personal Data Protection Act 2023 (DPDP Act) in relation to your customers.
We target platform availability of 99% measured monthly, excluding:
Our sole obligation for availability failures is to provide pro-rata service credits as described in Section 5. We do not guarantee uninterrupted service.
To the maximum extent permitted by applicable law:
Some jurisdictions do not allow limitation of liability for certain types of damages. In such cases, our liability is limited to the fullest extent permitted by law.
You agree to indemnify, defend, and hold harmless GrayOpus Technologies and its directors, employees, and agents from and against any claims, damages, or expenses (including legal fees) arising from:
By you: You may terminate your account at any time by providing written notice. Termination takes effect at the end of the current billing period.
By us: We may terminate or suspend your account immediately if:
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including Sections 8, 9, 11, 12, and 15) shall remain in effect.
We may update these Terms from time to time. We will notify you of material changes via email at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
If you do not agree with the revised Terms, you may terminate your account before the effective date.
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Delhi, India.
Before initiating any legal proceedings, both parties agree to attempt resolution through good faith negotiation for at least 30 days.
